By accessing or using our website, platform, interactive tools, and related educational services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accessing or using the Service on behalf of a school, educational institution, or commercial entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Teach Me Maths provides web-based mathematics learning software, interactive exercises, step-by-step worked solutions, diagnostic assessment tools, and teacher reporting dashboards designed primarily for secondary schools in New Zealand. The Service is made available through both a free tier for individual users and licensed subscription tiers for educational institutions.
OAuth Authentication: Users access the Service primarily via single sign-on mechanisms (such as Google OAuth 2.0). You are responsible for maintaining the confidentiality of your account credentials and device access.
Individual & Free Accounts: Individual users (including students and teachers) may sign up for a free account to access designated free content tiers.
School Licensing & Access: Subscribing schools receive elevated access privileges (e.g., premium content tiers and school reporting dashboards). Subscribing schools are responsible for ensuring that only authorized staff and enrolled students are granted access under their institutional license.
Student Accounts & Parental Consent: Subscribing schools act in loco parentis and assume sole responsibility for complying with parental notification or consent requirements under their internal policies prior to authorizing students under the age of 16 to create accounts or use the Service. Teach Me Maths does not knowingly collect personal information directly from students under the age of 16 without school authorisation.
Account Security: Users and subscribing institutions must notify Teach Me Maths immediately if they suspect unauthorized access or security breaches involving their accounts.
You agree to use the Service solely for legitimate educational purposes. You expressly agree not to:
All content, design elements, interactive exercises, question engines, step-by-step worked solutions, code, logos, and trademarks associated with Teach Me Maths are the exclusive intellectual property of Teach Me Maths or its licensors. Users and subscribing schools are granted a non-exclusive, non-transferable, revocable license to access and use the platform solely for educational, non-commercial purposes during an active subscription or trial period.
Pricing & Invoicing: Access to paid institutional features is subject to the pricing structure agreed upon during onboarding, online checkout, or invoice issuance. Pricing tiers are determined in accordance with Schedule 1 of these Terms. All prices are in New Zealand Dollars (NZD) and exclude GST unless explicitly stated otherwise.
Payment Terms: Payment terms for institutional subscriptions are specified on the applicable invoice or agreement.
Termination & Suspension: Users or subscribing schools may cancel their subscription or trial by contacting support. Teach Me Maths reserves the right to suspend or terminate accounts that breach these Terms, misuse the platform, or fail to pay applicable subscription fees when due.
Data Ownership: Subscribing schools retain full ownership of all student personal data, performance metrics, assessment records, and class data submitted to or generated on the platform.
Data Hosting & Cross-Border Transfer: Personal data collected through the Service is stored and processed on servers located in the United States, hosted by our platform provider (Base44, Inc.). By using the Service, you acknowledge that your personal data, including student data, will be transferred to and processed in the United States. Teach Me Maths takes reasonable steps to ensure that cross-border data transfers are subject to appropriate safeguards consistent with the requirements of the New Zealand Privacy Act 2020.
Privacy Compliance: Our collection, storage, use, and retention of personal data are governed by our Privacy Policy, which complies with the New Zealand Privacy Act 2020.
Data Incident Notification: In the event of a confirmed security incident or data breach impacting personal information held by Teach Me Maths, we will notify the designated contact of affected subscribing institutions without undue delay to enable compliance with statutory reporting obligations under the Privacy Act 2020.
Data Deletion: Upon contract termination, account cancellation, or written request from an authorized school administrator, student records will be removed from active databases in accordance with our Privacy Policy data retention schedule.
"As-Is" Basis: The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including performance, uninterrupted availability, or fitness for a particular purpose. While we strive for mathematical accuracy, Teach Me Maths does not warrant that the platform will be completely error-free.
Limitation of Liability: To the maximum extent permitted by New Zealand law, Teach Me Maths shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the Service. Our total aggregate liability shall not exceed the total amount paid by you or your institution to Teach Me Maths in the 12 months preceding the claim.
We may update these Terms from time to time to reflect platform enhancements, operational changes, or legal obligations. We will notify users and subscribing schools of significant updates via email or through a prominent notice on the Service. Continued use of the platform following any changes constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.

1. Roll Reference Date. A school's pricing tier is determined by its total roll as published in the Ministry of Education's annual 1 March roll return, as displayed on Education Counts ([educationcounts.gov](https://educationcounts.gov)t.nz).
2. Fallback for Unpublished Returns. If a school's current-year 1 March roll return has not yet been published on Education Counts at the time of license creation or renewal, the most recently published roll return shall be used. The tier shall be reassessed once the current-year return becomes available, and any adjustment shall apply from the next billing cycle.
3. Mid-Term Lock. A school's pricing tier is locked for the duration of the license term and shall not be reassessed due to interim roll fluctuations (including the July roll return). Tier review occurs only at license renewal, at which point the most recent 1 March roll return available on Education Counts applies.
4. Source of Truth. Education Counts ([educationcounts.gov](https://educationcounts.gov)t.nz) is the sole authoritative source for roll figures used in tier determination. Figures from other sources (school websites, ERO reports, self-reported counts) shall not override the Education Counts figure.
5. Dispute Resolution. If a school disputes the tier assigned based on the Education Counts roll figure, the school may notify Teach Me Maths in writing within 30 days of license issuance or renewal. Teach Me Maths shall verify the figure against Education Counts and adjust the tier if the published figure supports a different band. The adjusted tier applies prospectively from the next billing cycle; no retrospective charges or refunds shall apply.
6. New Schools. Schools that do not yet have a published roll return on Education Counts shall be assigned a tier based on their Ministry of Education estimated roll or enrolment projection, as provided by the school. The tier shall be reassessed at the next license renewal using the first available 1 March roll return.
Current pricing tier rates and roll bands are available on request and are confirmed in the applicable invoice or license agreement at the time of subscription.
